On topic: If the courts wanted to stop it, they would've taken up the cases and formally discredited them. They quite literally pushed the case back into the court of public opinion, to Trump's benefit.
I think they also didn't want to bare any responsibility for the consequences of a decision. Which- I can't really say I blame them considering the roving mobs these days, ready to murder, showing up at peoples homes in the middle of the night. Having the houses take care of it spread-loads the responsibility.
