But seriously, you have to be arrested and the DA has to have something to charge you with. If someone just breaks into your house and you shoot him you won't be charged. If someone breaks in, sees you, runs out and you shoot him outside then it is a crime in CA. It might not be right, but make sure he dies INSIDE YOUR HOUSE!
